THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION NO.12707 OF 2018 ORDER:

The petitioner challenges notice issued under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905 ("the Act", for short). At the first instance, this Court, on 13.04.2018, granted stay of further proceedings in Rc.No.B/17916/2007. The respondents filed petition to vacate the interim order. After perusing the counter affidavit, this Court is satisfied that no ground is made out for challenging notice issued under Section 7 of the Act. The petitioner can file his explanation and it is for the fifth respondent to act in accordance with law. This Court if considers either the case of the petitioner or the reply given by respondents, the same may prejudice the case of one of the parties.

Therefore, by leaving it open to fifth respondent to act in accordance with law, since a notice is issued, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
