THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.14872 of 2019 ORDER:

This writ petition is filed seeking a Writ of Mandamus to declare the delay and inaction on the part of the first respondent in registering the FIR pursuant to the complaint made by the petitioner despite the contents thereof clearly disclosing the commission of the cognizable offence, as arbitrary, illegal and contrary to Section 154 Cr.P.C. By order, dated 25.07.2019, this Court directed the Deputy Superintendent of Police, Adilabad, to enquire into the matter and take action against the first respondent for refusing to receive the complaint sent by the petitioner through registered post with acknowledgment due and inform this Court through the learned Assistant Government Pleader for Home.

Today, learned Assistant Government Pleader for Home produced before this Court, the written instructions, dated 25.10.2019, of the Inspector of Police, Adilabad Rural Police Station, Adilabad District, whereby it is stated that pursuant to the directions of this Court, a Charge Memo was issued to the first respondent on 28.07.2019, as per the proceedings of the Sub-Divisional Police Officer, Adilabad, vide proceedings No.4/MPR/SDPO-A/2019. By the said written instructions, it is also submitted that after giving explanation by the Charged Officer, as charges were proved, the Sub-Divisional Police Officer, Adilabad, vide proceedings of the same number, dated 30.09.2019, awarded 'CENSURE'.

In view of the aforestated written instructions, the writ petition is closed, as no further orders are required to be passed, inasmuch as appropriate action had already been taken against the first respondent by the authorities. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
