THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 29781 OF 2017 O R D E R:

Questioning the inaction on the part of Respondents 1 and 2 in investigating into Crime No. 113 of 2017 dated 30.01.2017 registered for the offences punishable under Sections 420, 417, 405 and 406 of the Indian Penal Code and filing the final report under Section 173 of the Code of Criminal Procedure, this Writ Petition is filed.

Heard learned counsel for the petitioner.

Learned Government Pleader for Home (Telangana), based on the written instructions furnished by the Sub-Inspector of Police, Banjara Hills Police Station, submits that during the course of investigation into Crime No. 113 of 2017, notice under Section 91/160 of the Code of Criminal Procedure dated 07.03.2017 was issued to the petitioner - complainant requesting him to produce the relevant witnesses and the supported documents, but so far, the same has not been done.

As it is the stand of the Investigating Officer that the petitioner had not produced any documents to support his contention, he shall be entitled to send the same to the 2nd respondent Station House Officer through Registered Post within two weeks from today and on receipt of such material, the latter shall take the same into consideration and file necessary charge sheet as per the provisions of the Code of Criminal Produce before the appropriate Court.

The Writ Petition is therefore, disposed of. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
