Koppala Janakiram v. Emandi Eswaramma
THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY CIVIL REVISION PETITION Nos.2361, 2363 and 2374 of 2018 13.04.2018 Between:
Koppala Janakiram ..Petitioner and Emandi Eswaramma and another ..Respondents Counsel for the petitioner: Mr.M.S.V.S.Sudha Rani Counsel for the respondents: -- The Court made the following:
CVNR,J C.R.P.Nos.2361, 2363 and 2374 of 2018 13.04.2018 COMMON ORDER:
These three Civil Revision Petitions arise out of cognate interlocutory applications filed in O.S.No.1692 of 2005 on the file of learned I Additional Senior Civil Judge, Visakhapatnam, for the purpose of reopening the suit for recalling the plaintiff for adducing further evidence.
2.
Admittedly, the petitioner has not furnished any reason, whatsoever, for not filing the proposed documents earlier, though the suit has been pending from the year 2005. The applications were filed only after closure of the evidence on the side of the plaintiff. As assigning proper reasons is a sine qua non for maintaining an application for adducing additional evidence and as the petitioner failed to satisfy the said requirement, the Court below has rightly dismissed the applications, which were filed belatedly. 3.
Hence, I do not find any reason to interfere with the orders of the Court below and these Civil Revision Petitions are, accordingly, dismissed.
4.
As a sequel to dismissal of these C.R.Ps., respective I.A.No.1 of 2018 filed in these C.R.Ps. by the petitioner for interim reliefs stand dismissed as infructuous.
