SMT JUSTICE T. RAJANI CRIMINAL PETITION No.1239 OF 2017 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in Crime No.1102 of 2015 on the file of Rajendranagar Police Station, Cyberabad, Ranga Reddy District against the petitioner/accused No.2. 2.

Heard learned counsel for the petitioner and the learned Public Prosecutor (Telangana) appearing for respondent No.1 and with their consent, this criminal petition is disposed of at the stage of admission.

Learned counsel for the petitioner contends that except an averment that the de facto complainant was introduced to accused No.1 through accused No.2, no other averment is made in the complaint.

What is the relationship between accused No.1 and accused No.2 and whether there is any understanding between both of them in committing the alleged offence, is a matter which has to come to light after due investigation. Therefore, it is not a fit case for quashing the proceedings in the said crime, at this stage. However, the petitioner can approach this Court if after investigation, no material is gathered against him. 5.

With the above observation, this Criminal Petition is disposed of.

Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
