THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.5969 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. challenging the docket order dated 02.05.2017 in C.C.No.348 of 2015 on the file of the Court of the I Additional Judicial Magistrate of First Class, Proddatur.

Heard the learned counsel for the petitioners. 3.

A perusal of the record reveals that the petitioners/accused Nos.3, 9 and 10 are facing trial in C.C.No.348 of 2015 for the offences punishable under Sections 138 and 142 of the Negotiable Instruments Act, 1881. On 02.05.2017 the trial Court directed the petitioners to furnish a personal bond for Rs.1,00,000/- each with one surety for the like sum by the next date of hearing i.e., on 09.06.2017.

The only point urged by the learned counsel for the petitioners is the condition imposed by the trial Court is onerous. It appears that the trial Court directed the petitioners to execute the personal bonds to ensure their presence in future. 5.

Having regard to the facts and circumstances of the case, I am of the considered view that it is a fit case to modify the impugned order.

In the result, the docket order dated 02.05.2017 in C.C.No.348 of 2015 on the file of the Court of the I Additional Judicial Magistrate of First Class, Proddatur, is modified as follows:

"The petitioners are directed to execute a personal bond for Rs.20,000/- each with one surety for the like sum". 7.

With the above direction, the Criminal Petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
