THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO Criminal Petition No.7204 of 2017 ORDER :
Heard the learned counsel for the petitioners/ A.1 and A.2 in C.C.No.428 of 2014 on the file of the Judicial Magistrate of First Class, Thorrur, taken cognizance for the offence punishable u/ sec.34(e) of A.P.Excise Act, outcome of Cr.No.35 of 2014 of P.S.Maripeda, and also the learned Public Prosecutor for the respondent-State and perused the grounds urged in the quash petition and the police final report from the crime registered based on the occurrence report with reference to the disclosure statement of A.1. A perusal of the record, there is nothing to quash the proceedings but for to say all available defences of the petitioners/ A.1 and A.2 are left open including to file any application u/ sec.251CrPC seeking to discharge them. Needless to say any application to file u/ sec.205CrPC, for the learned Magistrate to permit through special vakalath holder with necessary conditions for personal appearance as and when required.
