HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 12513 OF 2012 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself. The present Writ Petition came to be filed seeking to declare the action of the third respondent in threatening to dispossess the petitioner from the land admeasuring 60 square yards in Survey No.277/P of Saradanagar, Greater Visakha Municipal Corporation of Ward No.71, Pendurthi Mandal, Visakhapatnam District, without following due process of law, as illegal and arbitrary and consequently direct the respondents not to interfere with the possession of the petitioner, without following due process of law.

The case of the petitioner is that after having migrated from Orissa, she came down to Visakhapatnam and has been residing in a land admeasuring 60 square yards in Survey No.277/P of Saradanagar, Greater Visakha Municipal Corporation of Ward No.71, Pendurthi Mandal, Visakhapatnam District, since more then 10 years by erecting a thatched house. It is stated that the petitioner and her husband, being poor, have been contributing certain amount for erecting the thatched house by doing daily wage work and hence sought a direction to stay their dispossession from the land. Learned counsel for the petitioner submits that in view of the interim orders passed by this Court on 26.04.2012, the petitioner may not be dispossessed, without following due process of law.

Learned Government Pleader did not oppose the submission made by the learned counsel for the petitioner. Without going into merits of the case and having regard to the circumstances stated above, the Writ Petition is disposed of directing the respondents not to dispossess the petitioner from her property, without following due process of law. No costs. Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall also stand closed.
