The petitioner was appointed as a fair price shop dealer of shop No.14027 of Chinnakorukondi Village, Kalluru Mandal, Khammam District and his authorization is valid up to 31.03.2016. While so, on 25.09.2015 the Vigilance Inspector of Khammam inspected the petitioner's fair price shop and recorded certain variations in the stock, which were within the permissible limits under the Control Order. Thereafter, the officials have initiated proceedings under Section 6-A of the Essential Commodities Act by seizing ground stock and sent report to the Joint Collector, Khammam. So far the authorization of the petitioner is neither suspended nor cancelled but the authorities stopped supply of essential commodities. Challenging the action of the respondents in not supplying the essential commodities, the present Writ Petition is filed.
Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies for the respondents. The petitioner was appointed as a fair price shop dealer of shop No.14027 of Chinnakorukondi Village, Kalluru Mandal, Kmammam District. The authorization of the petitioner is subsisting as on today. As long as the authorization of the petitioner is in force, the petitioner is entitled for supply of essential commodities. In the circumstances, the Writ Petition is, disposed of directing the third respondent to supply essential commodities to the petitioner so long as the authorization of the petitioner is in force. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed. ________________________ (A.
