THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.12718 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the writ petitioner questioning the action of the respondents 1 to 3 in not completing the investigation into the case in Crime No.82 of 2014, registered, on 26.06.2014, by the Station House Officer, Parchur Police Station, Parchur Village and Mandal, Prakasam District/3rd respondent herein, against the unofficial respondents 4 to 6 herein, for the offences punishable under Sections 407, 409, 418 & 420 of Indian Penal Code, 1860. 2.

I have heard the submissions of Sri B.S.Prasad, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (A.P.) appearing for the respondents 1 to 3. I have perused the material record.

At the hearing, learned counsel for the petitioner would submit that if a direction is given to expedite the investigation into the afore-stated crime and final report is directed to be filed, as early as possible, the grievance of the writ petitioner stands redressed.

Learned Government Pleader for Home, on oral instructions, submits that the investigation has made considerable progress and that the petitioner may be directed to co-operate with the investigation and that the Police Officer concerned will take steps for expediting the investigation into the crime.

Recording the submissions, the Writ Petition is disposed of directing the Station House Officer, Parchur Police Station, Parchur Village and Mandal, Prakasam District/3rd respondent herein, to expedite the investigation into the afore-stated crime and file a final report, either way, by strict adherence to the procedure established by law. However, it is made clear that the petitioner shall extend necessary co-operation to the Investigating Officer during the course of investigation into the afore-stated crime. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
