THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38257 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the 2nd respondent in registering the Crime No.172 of 2016, dated 14.10.2016, against the petitioners, as illegal and arbitrary. Heard and perused the material available on record. The main grievance of the petitioners is that the 3rd respondent lodged a complaint before the 2nd respondent alleging that the petitioners approached the 2nd respondent and expressed their willingness to sell the land in Survey No.230 to an extent of Ac. 10.09 guntas, situated at Gunjaluru Revenue Village of Nalgonda District and that the petitioners executed an agreement on 29.10.2014 in favour of the 4th respondent and received an amount of Rs.

13,50,000/- in installments and later, the 4th respondent came to know that the land belongs to Government and hence, the 4th respondent was cheated by the petitioners. The main grievance of the petitioners is that the 2nd respondent has registered the said complaint as Crime No.172 of 2016, dated 14.10.2016, against the petitioners for the offences punishable under Sections 417, 420 and 506 IPC without there being any offence committed by the petitioners and also without conducting preliminary enquiry.

Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in Crime No.172 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to execute a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety to the satisfaction of the 2nd

respondent as surety for their future appearance as and when required for the purpose of investigation.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
