SMT. JUSTICE T.RAJANI MACMA. No.1755 of 2008 JUDGMENT:

This appeal is filed by the appellant, who is respondent No.2 in the lower Court and he is the insurer of the crime vehicle. The appellant assails the award of the III Additional Chief Judge, City Civil Court, Hyderabad in OP.No.2316 of 2005 dated 02-07-2007 on the ground that the driver of the vehicle involved in the accident did not have valid driving licence. At the hearing learned counsel for the appellant submits that subsequently driving licence of the driver was renewed, but the claimant did not bringforth any evidence with regard to the said fact. However, he concedes that the award made by the lower Court to the effect of directing the Insurance Company to pay and recover can be sustained.

Hence, the Appeal is dismissed by confirming the award of the lower Court. As a sequel, miscellaneous petitions if any, pending in this appeal shall stand closed.
