THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 19236 of 2012 ORDER:

This Writ Petition was filed assailing the inaction of the Mining Authorities in stopping the mining and blasting activities by respondents 5 to 7 in Survey No.37 of

V. Venkatayapalem, Khanapuram Haveli, Khammam District. The Assistant Director of Mines and Geology, Khammam, filed a counter affidavit stating that the execution of lease deeds in favour of the private respondents was done strictly in accordance with the due procedure and that mining operations were being undertaken by them as permitted.

Sri Kowturu Vinaya Kumar, learned counsel appearing for the petitioners, however stated that the petitioners 1 and 3 have constructions near the leased areas of the respondents and the mining and blasting operations undertaken by the private respondents may cause them adversity.

Taking note of the above submission, this Writ Petition is closed leaving it open to the petitioners to complain to the competent authorities in the event there is any violation, be it of the lease conditions or any other legal restrictions, in the context of the mining and blasting operations undertaken by the private respondents in Survey No.37 of V. Venkatayapalem, Khanapuram Haveli, Khammam District. Pending Miscellaneous Petitions shall also stand closed. No order as to costs.
