HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY Writ Petition No. 37134 of 2012 ORDER :

It is the case of the petitioner that he is the owner of an extent of 152.07 sq.yds in Sy.No.280 situated at Achampet, Mahabubnagar District having purchased the same vide registered sale deed dated 27.01.1982. She applied for construction of house along with plan on 03.04.2012 before the 1st respondent. But no orders are passed within the stipulated time. Petitioner commenced construction by virtue of deemed permission. Meanwhile, 1st respondent issued impugned notice dated 20.07.2012 to her to stop the construction. Aggrieved by the same, present writ petition is filed. Now, petitioner filed W.P.M.P.No.41986 of 2015 stating that pending writ petition, she has filed an application on 26.09.2015 for grant of building permission before the 1st respondent. But no orders have been passed.

Heard both sides.

In view of facts and circumstances, this writ petition is disposed of directing the 1st and 3rd respondents to consider the application of the petitioner dated 26.09.2015 for building permission and pass appropriate orders in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. However, petitioner shall not make any further construction unless permission is granted by the respondent authorities.

There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any pending in this Writ Petition, shall

stand dismissed.
