THE HON'BLE SRI JUSTI CE ABHI NAND KUMAR SHAVI LI WRI T PETI TI ON No.25562 of 2007 ORDER:

This writ petition is filed seeking a writ of mandamus, declaring that the management of properties and affairs of Shankararadhya Mutt, Kavadiguda, Hyderabad, vest with the Matadhipati, the 4th respondent, and respondent No.5 ceased to hold office consequent to the appoint of Matadhipati, vide proceedings Rc.No.SMSM/15/2007, dated 23.11.2007/26.11.2007, as illegal, arbitrary and without jurisdiction. Heard Sri T.Lakshminarayana, learned counsel for the petitioner and the learned Government Pleader for Endowments. When the matter is taken up for hearing, it is informed by the learned Government Pleader for Endowments that Matadhipati of the Mutt, respondent No.4, had filed O.A.No.612/2010 before the Endowments Tribunal, Hyderabad seeking eviction of the petitioner. In view of the above submission made by the learned Government Pleader, the impugned order issued by respondent No.5 does not survive and the eviction of the petitioner is subject to the outcome of O.A.No.612/2010, preferred by respondent No.4. With the above observations, the writ petition is closed. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
