THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10100 of 2015 ORDER:

This Criminal Petition is filed by the petitioners - A2 & A3, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in Crime No.49 of 2015 on the file of Women Police Station, Rajahmundry Urban, registered for the offences punishable under Sections 498-A, 494 and 506 read with 34 IPC and 3 & 4 of the Dowry Prohibition Act.

Heard and perused the material available on record. The marriage between A1 and the de facto complainant was performed in the year 2006. After marriage, the de facto complainant went to her parents-in-law house at Rajahmundry. Thereafter, the petitioners along with A1 started harassing the de facto complainant for demand of additional dowry. Since the present complaint arises out of matrimonial dispute, this Court is of the view that arrest of the petitioners would cause prejudice in case of future settlement between the parties. Therefore, this Court is inclined to grant anticipatory bail to the petitioners.

In the circumstances, the petitioners - A2 & A3 are directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender, they shall be released on bail on their executing personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) each with one surety for the like sum each to the satisfaction of the said Magistrate. Further, the petitioners are directed to appear before the Station House Officer concerned, as and when required. Accordingly, the Criminal Petition is allowed. ______________ RAJA ELANGO, J October 07, 2015.
