HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.8593 of 2016 ORDER:

Heard counsel for the petitioner and the Government Pleader for Revenue appearing for the respondents.

2. Petitioner's grievance is that he had applied to the 3rd respondent on 19.01.2016 for survey of her land admeasuring 242 Sq.yards in Survey No.14/8 of Kapusettivanipalem Village, Anakapalle Mandal, Visakhapatnam District and that the 3rd respondent is not taking any action, even though she had paid charges for the said survey.

3. On 03.03.2016 in W.P.No.6690 of 2016 this Court has considered the issue of survey in respect of private land, subject to collection of requisite charges, by the officials of the Survey Department.

4. Therefore, for reasons alike, this Writ Petition is also disposed of directing the 3rd respondent to conduct survey by demarcating and fixing boundaries to the petitioner's land, after issuing notice to all the affected parties and after collecting necessary charges for the same, within a period of twelve (12)

weeks from the date of receipt of a copy of this order. It is made clear that any survey conducted by the 3rd respondent will not affect the right, title and interest of any third parties. There shall be no order as to costs.

5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
