THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4147 OF 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/Accused for grant of anticipatory bail in the event of his arrest in connection with Crime No.13 of 2019 of Begum Bazar Police Station, Hyderabad, registered for the offences punishable under Sections 420 and 406 I.P.C and Section 7 of the Essential Commodities Act.

Heard learned counsel for the petitioner/Accused and the learned Additional Public Prosecutor representing the respondent/State. Perused the record.

The allegation against the petitioner is that he is doing business by creating PDS blue kerosene into white kerosene and thereby committed the alleged offence.

Learned counsel for the petitioner/accused would submit that the petitioner has been falsely implicated in this case; that there is no specific allegation against the petitioner to connect him with the present crime and that entire investigation is completed in this case and hence, he prays to grant bail to the petitioner. 5.

Learned Additional Public Prosecutor opposed the grant of the bail to the petitioner/accused.

Since there are allegations against the petitioner, which are grave in nature, I am not inclined to grant anticipatory bail to the

petitioner. However, if the petitioner/accused surrenders before the Court concerned and moves an application for grant of bail, after giving notice to the Public Prosecutor, the same shall be considered and disposed of in accordance with law. 8.

With the above observation, the Criminal Petition is dismissed.

Miscellaneous petitions, if any, pending in this petition shall stand closed.
