THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.4339 OF 2018 ORDER:

The petitioner/A.2 in Crime No.8 of 2018 of Humayun Nagar Police Station, Hyderabad, filed this petition to issue a direction to the Station House Officer to release him on bail in the event of his arrest in connection with the above crime registered for the offence punishable under Section 307 and 120(B) of the Indian Penal Code, 1860 (for short 'IPC') and Section 27 of the Indian Arms Act. The petitioner raised several contentions in the petition. But, during the argument, Sri T.Bala Mohan Reddy, learned counsel for the petitioner, requested this Court to pass a similar order in terms of the order passed by the Apex Court on 02.04.2018 in W.P.(Crl.) No.64 of 2018.

In view of the request made by the learned counsel for the petitioner, without going into the merits of the case, the petitioner is directed to surrender before the concerned Magistrate, within two weeks from today and moves an application for bail with at least one day advance notice to the Public Prosecutor, the learned Magistrate is directed to decide the same as far as possible on the same day, in accordance with law.
