This writ petition is filed to declare the notification dated 09-08-2017 of the respondent No.2 in putting up Two (2) categories of upper age limit for the staff of PACS i.e. 45 and 55 years in rules of application, for appointment of Staff Assistant/Clerks for in service of PACS affiliated to Kakinada DCC Bank as illegal and arbitrary.

Today, when the matter is listed, learned counsel for the petitioner says that the respondent-bank has power under Section 115-D of A.P.Co-Operative Societies Act, 1964 for relaxing the age. As such, the petitioner made application for considering the same.

Learned Standing Counsel for the respondent-bank submits that in similar matters, no interim orders were granted and today is the last date for making application through on-line.

It is to be seen that notification is issued on 09-08-2017. The petitioner made application before in time. It is stated by learned counsel for the petitioner that in similar circumstances, in the year 2011, this Court granted interim orders.

In view of facts and circumstances of the case, without expressing any opinion on merits, the respondentbank is directed to dispose of the application stated to have been filed by the petitioner in accordance with law as soon as possible.

Accordingly, the writ petition is disposed of.
