THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE NO.2524 OF 2016 ORDER:

This contempt case was instituted alleging willful disobedience to the order dated 10.02.2016 passed in W.P.No.4116 of 2016. By the said order, the police authorities were directed to take appropriate action on the complaint dated 26.07.2014 of the petitioner in the light of the law laid down by the Supreme Court in LALI TA KUMARI V/ s. GOVERNMENT OF UTTAR PRADESH1.

The Sub-Inspector of Police, Huzurnagar Polcie Station, Nalgonda District, filed a counter-affidavit stating that upon the petitioner's complaint dated 26.07.2014, a preliminary enquiry was initiated and it was found that the contents of the complaint related to an election and did not come within the purview of the police authorities. This fact was stated to have been informed to the petitioner on 15.10.2016 and 24.10.2016.

This aspect of the matter was not denied by the petitioner despite filing a reply-affidavit.

In the light of the aforestated facts, this Court cannot infer any disobedience, much less willful disobedience, on the part of the police authorities warranting exercise of contempt jurisdiction.
