THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.29443 of 2017 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Transport.

In the present Writ Petition, the petitioner herein is seeking a direction to the third respondent to refund the alleged excess tax collected by the fourth respondent on 05.08.2017 and 06.08.2017 in respect of the subject vehicles. A perusal of the material available before this Court discloses that, in fact, for redressal of the grievance of the petitioner herein, the petitioner submitted a representation, dated 17.08.2017, before the third respondent and the same is pending consideration and no action has been taken so far. Eventually a request is made by the learned counsel for the petitioner to direct the third respondent to take action on the said representation and pass orders, strictly in accordance with law, by fixing some timeframe.

On the other hand, it is submitted by the learned Government Pleader that the said representation, said to have been submitted by the petitioner herein, would be verified and appropriate orders would be passed in accordance with law.

In view of the above, the Writ Petition is disposed of, directing the third respondent to pass appropriate orders on the representation, dated 17.08.2017, said to have been submitted by the petitioner herein, within a period of two weeks from the date of receipt of a copy of this order.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. __________________ A.V.SESHA SAI, J 11th September, 2017 Tsy
