THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.452 of 2017 ORDER :

This Criminal Petition is filed under Section 482 Cr.P.C. seeking modification of the condition imposed by the I Additional District and Sessions Judge, Visakhapatnam District in Crl.M.P.No.4652 of 2016. By an order dated 30.12.2016, passed in Crl.M.P.No.4652 of 2016 the learned I Additional District and Sessions Judge, Visakhapatnam, while releasing the petitioner on bail directed him to furnish personal bond of Rs.50,000/ - and two sureties each who shall each furnish a fixed deposits of Rs.50,000/ - drawn in the name of the trial Court and the same shall be produced to the satisfaction of the learned Additional Metropolitan Magistrate, Anakapalli.

The counsel for the petitioner submits that the petitioner is labourer and it is difficult for him to furnish surety amount of Rs.50,000/ -. Having regard to the facts and circumstances of the case, the condition of the petitioner furnishing personal bond of Rs.50,000/ - and two sureties each who shall each furnish a fixed deposit of Rs.50,000/ - drawn in the name of the trial Court is modified as under: " The petitioner shall furnish personal bond of Rs.25,000/ - (Rupees Twenty Five Thousand only) with two local sureties for a likesum each who shall each furnish a fixed deposit of Rs.25,000/ - drawn in the name of trial Court and shall produce the same to the satisfaction of Additional Metropolitan Magistrate, Anakapalli" . All other conditions shall remain unaltered.
