ORDER
This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in Crime No.473 of 2026 before the Madhapur Police Station, Cyberabad Commissionearte, registered for offence
punishable under Sections 143, 144 of BNS and Sections 3, 4 and 5 of the PIT Act.

The brief facts of the case are that on 25.03.2026, based on credible information, the police conducted a raid at SS Beauty Studio Spa, Madhapur, and found the petitioner at the reception, while a customer and a woman were found in a semi-nude condition in a room, and another woman was found separately. It was alleged that prostitution was being carried out under the guise of a spa, and various items including mobile phones, cash, and other materials were seized.

Heard Sri B. Akash Kumar, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachander Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner was falsely implicated and her name was not mentioned in the initial complaint and that the case was based mainly on inadmissible confessional statements and no substantial material evidence was collected. He further
submitted that the raid was conducted by an officer not authorized under law, rendering the proceedings vitiated. He contended that the petitioner, being a woman, was entitled to leniency and that investigation was substantially completed, there was no risk of tampering with evidence, and that bail is the rule and jail is an exception. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

Learned Additional Public Prosecutor opposed the bail petition, contending that the petitioner was the organizer of the prostitution racket operating under the guise of a spa and that the raid resulted in the apprehension of persons in compromising situations and seizure of incriminating material, clearly indicating illegal activities. He further submitted that the allegations were serious in nature and releasing the petitioner on bail at this stage may adversely affect the ongoing investigation. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on
record, it appears that the petitioner is in jail since 26.03.2026. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 9 witnesses have been examined.
Considering facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the X Additional Judicial Magistrate of First Class, Ranga Reddy District at Kukatpally, Cyberabad .
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of
investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
