THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43677 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 2nd respondent in not initiating the action on the complaint filed by the petitioner and also refusing to issue acknowledgment of the same, as illegal and arbitrary, and consequently, direct the 2nd respondent to take action on the complaint lodged by the petitioner.
Heard and perused the material available on record. The main grievance of the petitioner is that the Station House Officer, Arandalpet Police Station, Guntur - 2nd respondent is not registering a case basing on the complaint lodged by the petitioner 30.11.2016 against the persons mentioned in the said complaint. Considering the grievance of the petitioner, the 2nd respondent is directed to register a case against the persons mentioned in the complaint, dated 30.11.2016, lodged by the petitioner, if the said complaint discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved over the action of the 2nd respondent, he is at liberty to approach the superior officer of the 2nd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C. Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J December 16, 2016.
