When this matter is taken up for hearing, none appeared for the petitioner in spite of the fact that the Writ Petition is posted under the caption, "For dismissal".

Learned Standing Counsel for the respondents contends that the petitioner had filed this Writ Petition seeking alternative employment consequent upon his medical invalidation as a Driver vide orders dated 16.9.1999. Learned Standing Counsel further submits that the case of the petitioner was considered for alternative employment vide proceedings dated 4.2.2004 and the petitioner was appointed as a Shramik. 3.

In view of the above said submission made by the learned Standing Counsel, this Court is of the considered view that the cause in the Writ Petition does not survive.

Accordingly, the Writ Petition is dismissed as infructuous. Pending miscellaneous petitions, if any, shall stand dismissed. No order as to costs.
