HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.12746 OF 2018 O R D E R:

This writ petition is filed against the proceedings vide Rc.No.Spl/C1/2018-4, dated 05.04.2018 issued by the 4th respondent, wherein and whereby petitioner was suspended pending enquiry.

Learned counsel for the petitioner submits that petitioner is not competent to issue the PTO and ETR and it is respondents 3 and 4 who are competent to issue the same, as such, question of allegations made against the petitioner is without any basis and without application of mind. On the other hand learned Government Pleader for Services submits that serious charges of fabrication are alleged against the petitioner and that the truth or otherwise of the charges will be gone into the enquiry to be conducted, as such, no interference is called for.

Normally, this Court will not interfere with the order of suspension, unless is it issued without jurisdiction or without application of mind.

A reading of the impugned order goes to show that serious allegations are made against the petitioner. Though learned counsel for petitioner denied the same, that aspect cannot be enquired now, at this stage. In view of the same, I

do not see any reason to interfere with the order of suspension.

Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 13.04.2018 tk
