THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 14603 OF 2010 O R D E R :

This writ petition is filed challenging the order dated 04.05.2009 passed by the 1st respondent rejecting the petitioner's application for grant of Freedom Fighter Pension.

This Court on 25.06.2010, while admitting the writ petition granted interim direction directing the 2nd respondent to send the verification report of the petitioner to the 1st respondent so as to consider the same by the 1st respondent for grant of Freedom Fighter Pension to the petitioner under Swathantra Sainik Samman Pension Scheme 1980. Counter affidavit is filed by the 1st respondent stating that they have not received any verification report from the State Government; that basing on the available material, they have passed the impugned order; and that as and when they receive report from the 2nd respondent, the claim of the petitioner would be considered.

Heard learned counsel for the petitioner, Sri G.Venkateswarlu, learned Standing Counsel for Central Government appearing for 1st respondent and learned Assistant Government Pleader for Revenue. In view of the aforesaid facts and circumstances, the 2nd respondent is directed to send verification report to the 1st respondent as directed by this Court on 25.06.2010 in WP.MP.No.18369 of 2010, as expeditiously as possible, if not already sent and after receiving the said verification report,

the 1st respondent shall consider the case of the petitioner, in accordance with the scheme.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
