HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.38948 of 2012 ORDER:
Heard learned counsel for the petitioner and Sir P.Kesava Rao, learned Standing Counsel for CBI.
2. The petitioner prays for Certiorari to call for the records relating to R.C No.02 (A)/2012, dated 28.03.2012 registered by 1st respondent and quash the FIR insofar as the petitioner is concerned.
3. At the time of hearing, the learned counsel appearing for the parties draw the attention of the Court to the charge sheet filed by the 1st respondent and also statements made in the charge sheet insofar as few accused are concerned, the paragraphs which has bearing on the present case reads as follows: "The evidence available on record is not sufficient to warrant prosecution again the above mentioned FIR named delinquent accused persons to substantiate the charges. Hence, Sri Danduboyina Veera Venkata Satyanarayana Murthy (A-9), S r i Danduboyina Srinivasa Rao (A-10), Sri Danduboyina Subba Rao (A-11), Smt.Danduboyina Sujatha (A-12)/ petitioner herein and Smt.Tananki Radhamani (A13) were not sent up for trial under this charge sheet."
4. From the above, it is clear that the Investigating Agency did not find material to proceed further among others the petitioner herein. The cause of action in the petition does not survive as the charge sheet filed in FIR No.RC 02 (A)/2012 is placed on record.
5. Accordingly, the writ petition is closed. No order as to costs.
6. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
