THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.8736 of 2017 ORDER:

The petitioner is a resident of Dhoolpet and he is eking out his livelihood by making clay idols. However, he was involved in a case of illicit liquor. It was registered as COR No.951 of 2016 on 29.11.2016 under the provisions of the Andhra Pradesh Prohibition Act. He was remanded in the crime and obtained bail. Thereafter, he was also involved in another crime in COR No.973 of 2016 on 29.12.2016 under the provisions of the same Act. In the said case also he was remanded and obtained bail. Now when he received a notice on 15.02.2017 asking to pay an amount of Rs.50,000/- towards penalty or to show cause within seven days for enforcement of that penalty, he submitted his reply on 23.02.2017.

Challenging the issuance of the show cause notice dated 15.02.2017, the present Writ Petition is filed. Since the impugned notice is a show cause notice to which the petitioner already submitted his reply on 23.02.2017, this Court is not inclined to entertain the present Writ Petition, but directs the second respondent to consider the reply submitted by the petitioner and appropriate orders thereon in accordance with law. Till orders are passed by the second respondent, the second respondent shall not take any coercive steps against the petitioner.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 14.03.2017 vs
