HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.12958 of 2018 ORDER:

This writ petition is filed challenging the suspension order dated 02-12-2017.

It is stated by learned counsel for the petitioner that the petitioner has already filed WP.No.2341 of 2018 for setting aside the same impugned order dated 02-12-2017, but he has withdrawn the same with liberty. Learned counsel for the petitioner further says that since learned Standing Counsel gave oral undertaking that enquiry would be completed within four weeks, the writ petition was withdrawn. He also admits that no such undertaking was recorded, while withdrawing the writ petition.

Sri B.Mayur Reddy, learned Standing Counsel for the respondent-Corporation submits that no such undertaking was given and writ petition was withdrawn without seeking liberty to file fresh writ petition and the present writ petition cannot be maintained for the same relief. He further submits that four witnesses were already examined and another four witnesses will be examined. A perusal of the order dated 01-02-2018 in WP.No.2341 of 2018 goes to show that no liberty is sought for filing fresh writ petition for the same relief. As such, the present writ petition cannot be maintained.

In view of the same, no relief can be granted in the writ petition against the impugned order. However, the respondent-authorities are directed to complete the enquiry as expeditiously as possible preferably within a period of four weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
