THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.25619 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue writ, order or direction especially one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in not issuing the permit proceedings enabling the petitioner to purchase new auto rickshaw is illegal, arbitrary and violative of Article 14 and 19 (1)(g) of the Constitution of India and consequently direct the 3rd respondent to issue Form-20 & 21 and permit proceedings in favour of the petitioner for purchase of new three wheeler auto rickshaw and pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice."

Heard Sri Ch.Ravinder, learned counsel for the petitioner, and the learned Government Pleader for Transport appearing for the respondents.

When the matter is taken up for hearing, it is submitted by the learned counsel for the petitioner that for redressal of grievance of the petitioner herein, the petitioner submitted a representation, dated 06.07.2017, to respondent No.2 but no action has been taken on the same. A request is made by the learned counsel to direct respondent No.2 to take appropriate action on the said representation by fixing some timeframe.

On the other hand, it is submitted by the learned Government Pleader appearing for the respondents that the

representation said to have been submitted by the petitioner will be verified and considered and appropriate action will be taken strictly in accordance with law.

In view of the above, the Writ Petition is disposed of, without expressing any opinion on merits in the matter, directing respondent No.2 to verify and consider the representation, dated 06.07.2017, said to have been submitted by the petitioner herein and pass appropriate orders within a period of three (3) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
