THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.14972 OF 2019 ORDER:

Heard.

2. Petitioner claims to have purchased land to an extent of Ac.1.10 guntas in survey No.57 and Ac.1.00 guntas in survey No.63/5 situated at Nandigama Village, Patancheru Mandal, Sanga Reddy District, in the year 2005. On 23.12.2017, petitioner made an application in physical form to mutate his name in the revenue records. Alleging in action, this writ petition is filed.

3. The Telangana Record of Rights in Land and Pattadar Pass Books Act, 1971, and the Rules made thereunder prescribe a procedure for mutation and an application has to be filed within 90 days from the date of purchase. Apparently, the application for mutation was not filed within the time stipulated by the Act of 1971. Having regard to the same, it cannot be said that the respondent authorities are negligent in acting upon the request made by the petitioner. Therefore, the relief sought for by the petitioner cannot be granted.

3. Accordingly, the Writ Petition is dismissed. However, it is open to the petitioner to file an appropriate application, in accordance with law and if the same is permissible, the respondent authorities may consider the same, as per law. Miscellaneous petitions, pending if any, shall stand closed. No order as to costs.
