THE HONOURABLE SRI JUSTICE M.LAXMAN CRIMINAL PETITION NO.5398 OF 2023 ORDER :

This petition is filed seeking anticipatory bail under Section 438 of Criminal Procedure Code, 1973 (Cr.P.C). The petitioners are accused Nos.2 and 5 in Crime No.351 of 2023 of Alwal Police Station, Cyberabad. The offences alleged against the petitioners are under Sections 307 and 498-A of Indian Penal Code.

The sum and substance of case of the prosecution is that the victim's marriage was performed with Accused No.1 in the year 2014. After marriage all the accused allegedly harassed her physically and mentally demanding additional dowry. On 17.04.2023 in the mid night at about 12.00, while the victim with her son and mother were sleeping on the first floor of the house, she heard noise, woke up and found Accused No.1 was running away. Later they found that a live wire connected to the electric meter on the ground floor, such wires were kept by accused No.1
in order to kill victim and her family members. Subsequently, other accused allegedly came and maltreated the victim.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent - State. 4.
The serious allegation of Section 307 of IPC is against Accused No.1. Further the petitioners are separately staying and they are not with the victim's family. There are omnibus allegations attracting harassment. 5.
In the said background of case, this Court is inclined to grant anticipatory bail to the petitioners-accused Nos.2 and 5.

Accordingly, the Criminal Petition is allowed on the following terms and conditions:
(i) The petitioners/accused Nos.2 and 5 are enlarged on bail in the event of their arrest in connection with FIR No.351 of 2023 on the file of the Station House Officer, Alwal Police Station, Cyberabad on
their executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties to the like sum each to the satisfaction of concerned Station House Officer. (ii) The petitioners/accused Nos.2 and 5 shall abide by the other conditions stipulated in Section 438 (2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.
