Heard Mr. G.Venkateswara Rao for petitioner and the learned Assistant Government Pleader for Revenue for respondents. The petitioner prays for the following relief: "...writ of Mandamus declaring the action of the Authorities of the 4th respondent in threatening the petitioner herein to lodge criminal complaint in entering the subject land to an extent of 3-07 cents in S.No.141-4 and Ac. 1-61 cents in S.No. 144-1 situated at Chintalapalem Village, C.S. Puram Mandal, Prakasam District, A.P. for harvest of his ripened crops as biased, illegal, void and capricious and consequently direct the respondents not to take any coercive steps to dispossess the petitioner from the aforesaid subject land pending disposal of Appeal No. 3180 of 2010 on the file of the District Collector, Prakasam District, at Ongole..."
At the request of the respondents, the writ petition has been passed over from forenoon to afternoon. On instructions, a statement is made by the Assistant Government Pleader that respondents are not interfering with the possession and enjoyment of petitioner. The statement is placed on record and accepted. Admittedly, Appeal No.3180 of 2010 is pending before the 2nd respondent. After perusing the annexures filed along with the writ petition, this Court is satisfied that the 2nd respondent is directed to dispose of Appeal No.3180 of 2010 as expeditiously as possible preferably within three months from the date of receipt of a copy of this order. The possession of petitioner on subject land, as undertaken, shall not be interfered with or disturbed. The writ petition is disposed of. No order as to costs.
