HONOURABLE JUSTICE G. SRI DEVI CRIMINAL REVISION CASE No.794 OF 2019 ORDER:

This Criminal Revision Case under Section 397 read with Section 401 of the Code of Criminal Procedure, 1973, is preferred against the order dated 24.06.2019, passed by the learned VIII Additional District and Sessions Judge, L.B. Nagar, Ranga Reddy District, in Criminal M.P. No.253 of 2019 in Criminal Appeal No.533 of 2019, whereby and whereunder, the first appellate Court suspended operation of sentence of the petitioners on condition of their depositing Rs.10,00,000/- (Rupees ten lakhs only), out of the total compensation of Rs.99,00,000/- awarded by the trial Court in C.C. No.96 of 2018, within a period of one month therefrom.

2. Heard learned counsel for the petitioners and learned Public Prosecutor, and perused the material on record.

3. Though the revision case is filed seeking to set aside the order under challenge, learned counsel for the petitioners sought two

(2) months time to deposit the compensation amount of Rs.10,00,000/-.

4. Learned Public Prosecutor supporting the order under challenge prays to dismiss the revision as there are no grounds to entertain this revision or to extend the time for deposit of the amount.

5. Considering the facts and circumstances of the case, this Court is of the view that some time may be granted to the revision petitioners to deposit the amount and, therefore, the revision petitioners are directed to deposit the amount of Rs.10,00,000/- (Rupees ten lakhs only) within a period of six (6) weeks from today.

6. Accordingly, the Criminal Revision Case is disposed of modifying the order under challenge to the extent indicated above. As a sequel thereto, Miscellaneous Petitions, if any pending, in the revision stand closed.
