Zahoorakhanam v. Sri. M. Dana Kishore

THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 945 2019 ORDER:

This contempt case is filed complaining non-implementation of the order dated 30.04.2019 passed by this Court in W.P.No.9606 of 2019.

The above said order reads as under:

"The grievance of the petitioner is with respect to the inaction of respondent No.1 in stopping the illegal constructions made by respondent No.2, in spite of her making complaint with regard to the same.

It is the case of the petitioner that in the process of making constructions, respondent No.2 made violations and she made complaints/representations on 20.08.2018 and 15.04.2019, but no action was taken by the respondent authorities.

Learned Standing Counsel for Greater Hyderabad Municipal Corporation would submit that necessary action would be taken after verifying the allegations made by the petitioner.

Having regard to the respective submissions, the writ petition is disposed of with a direction to respondent No.1 and his subordinates to take action, in accordance with law, with respect to the grievance of the petitioner." Heard learned counsel for the petitioner.

In the affidavit, though the petitioner asserts that no action has been taken on the complaints/representations, dated 20.08.2018 and 15.04.2019, submitted by her, she has not stated as to whether she had verified with the authorities of the Corporation whether any action has been taken pursuant to the order of this Court. As of date, the petitioner had not made out any case even for issuance of notice to the respondent, since in the afore-stated order, there was no direction to the respondent to intimate the petitioner with respect to the action taken on the complaints made by her.

In those circumstances, the contempt case is dismissed. However, liberty is given to the petitioner to approach this Court, on verification, if she feels that the order has not been complied with. Miscellaneous petitions, if any, pending shall also stand dismissed.
