This Civil Revision Petition is filed under Section 115 of C.P.C. challenging the docket order dated 26.09.2016 passed in E.P.No.199 of 2016 on the file of the Court of the V Senior Civil Judge, City Civil Court at Hyderabad.

Heard the learned counsel for both the parties. 3.

At the time of arguments, the learned counsel for the first respondent-decree holder submitted that the first respondent is intending to withdraw E.P.No.199 of 2016.

In view of the submission made by the learned counsel for the first respondent, the Civil Revision Petition is allowed setting aside the docket order dated 26.09.2016 passed in E.P.No.199 of 2016 on the file of the Court of the V Senior Civil Judge, City Civil Court at Hyderabad. However, allowing of this revision petition does not preclude the first respondent to file a fresh E.P. in accordance with law. No costs.
