THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43449 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of respondent No.3 in not registering a First Information Report when a cognizable offence has been reported and in spite of he being directed by the XV Metropolitan Magistrate, Medchal to register the F.I.R. as illegal and arbitrary and consequently, direct respondent No.2 to take action against respondent No.3.

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that respondent No.3 is not registering a case against the concerned basing on the complaint lodged by her on 9.11.2015 before the aforesaid Magistrate, which was referred under Section 156(3) Cr.P.C. 4.

When the matter is called, it is informed by the learned Assistant Government Pleader for Home that already a case was registered on 19.11.2015 as per the direction of the learned Magistrate and the same was numbered as Crime No.678 of 2015. 5.

Recording the same, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
