The letter dated 03.05.2017 issued by the 3rd respondent Senior Divisional Retail Sales Manager, Indian Oil Corporation Limited in favour of the petitioner rejecting her candidature for appointment as KSK (Rural Retail Outlet) dealer at Viswanadhapalle, Khammam District on the ground that she was found not to have complied with the conditions for granting of dealership under open category, is challenged before this Court. Sri Dominic Fernandez, learned counsel appearing for the respondent - Indian Oil Corporation, on instructions, submits that the petitioner was found to have not satisfied the condition of maintaining Rs.12 lacs in the account and thereby she became ineligible. The same was informed to the petitioner through the letter impugned dated 03.05.

Though the learned counsel for the petitioner submits that the petitioner had made the representation on 16.06.2017 and also filed the proof of availability of Rs.12.50 lacs in her account, the material placed before this Court now discloses that Rs.12,01,000/- was deposited on 17.11.2014 and immediately on the same day, Rs.12 lacs was withdrawn. In other words, deposit and withdrawal was done only to show the availability of money with the petitioner though she did not have the said amount which goes to show her inability to satisfy the condition.

Even the present request of the learned counsel for the petitioner that the respondent Corporation may be directed to re-consider grant of dealership, in view of the representation dated 16.06.2017, also cannot be acceded to, as the representation ought to have been made by the petitioner within 10 days from the date of issue of the impugned letter.

In those circumstances, this Court does not find any merit in the Writ Petition and it is accordingly, dismissed. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
