CONTEMPT CASE NO.2258 OF 2016 ORDER:

Writ Petition No.24103 of 2015 was disposed of by order dated 03.08.2015, directing the petitioner to make a representation to the respondent-Corporation and on such representation being made by the petitioner, the Commissioner, Municipal-Corporation was directed to consider and pass orders thereon within three weeks thereafter and communicate the same to the petitioner. The grievance of the petitioner in the representation was that illegally staff of Municipal-Corporation and Contractor encroached into her property and destroyed one portion of her house and constructed open drainage channel.

The Officer is present. Affidavit is filed by him. According to the averments in the counter-affidavit, survey was conducted to find out about the alleged encroachment. As per the survey report, Engineering Section of the respondent Corporation was directed to take steps for realignment of drainage channel and the same fact was informed to the petitioner. It is further averred that a new drainage channel was constructed into underground channel through pipelines and the orders of the Court are complied with. The photographs are furnished to show that channel was diverted and underground channel was constructed. The contemnor also states that channel earlier dug was properly closed and no hindrance was caused to the petitioner.

In view of the said submissions, Contempt Case is closed. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
