Indian Overseas Bank, v. Debts Recovery Tribunal,
THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN And THE HON'BLE SRI JUSTICE S.RAVI KUMAR Writ Petition No.11592 of 2015 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) This writ petition is preferred to declare the proceedings of the Debts Recovery Tribunal in S.A.No.186 of 2014 dated 11.03.2014 granting an ex parte order of status quo as illegal and arbitrary. By the order in W.P.M.P.No.15319 of 2015 dated 15.06.2015, we requested the Debts Recovery Tribunal to hear and decide either the I.A., or the S.A. itself, on 26.06.2015, without adjourning the matter even if such a request is made by counsel for either of the parties. The Debts Recovery Tribunal was also directed to pass order either in the I.A., or in the S.A itself, on or before 30.06.2015. Sri M.V.K.
Viswanatham, learned counsel for the petitioner-Bank, would place before us a copy of the order passed by the Debts Recovery Tribunal, Hyderabad dated 30.06.2015 vacating the interim order, and dismissing I.A.No.1028 of 2014. Learned counsel would submit that, as the ex parte interim order of status quo dated 11.03.2014, has been vacated, the petitioner does not seek any further adjudication in this writ petition on merits; and the writ petition has become infructuous.
The Writ Petition is, accordingly, dismissed as infructuous.
The Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs. ______________________________ RAMESH RANGANATHAN, J _______________________ S.RAVI KUMAR, J 01st July 2015 JSU
