In anticipation of appointment of one from respondents 4 to 6 as fair price shop dealer of F.P. Shop No.25, Rajamahendravaram Municipal Corporation, the present writ petition is filed. 2.
The basis for invoking the extraordinary jurisdiction of this Court is that respondents 4 to 6 do not satisfy one of the eligibility conditions stipulated in the notification dated 07.10.2016.
Admittedly, the process of selection for appointment is underway. This Court, after examining the pleadings in the affidavit and also the annexures filed by the petitioner, is of the view that, at this stage of selection process, the writ prayer is premature, further this Court has no reason to doubt that the third respondent conforms to the stated conditions, examines the cases of respondents 4 to 6 strictly and a decision, as warranted, is taken. Finally, if the third respondent invites infirm decision, the petitioner is not left with a remedy. By giving liberty to the petitioner to avail the remedy of appeal, as and when a decision pursuant to the notification is taken, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
