ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/A3 seeking to quash the proceedings in Cr.No.197 of 2016 of Nandyal Taluk Police Station, Kurnool District, registered for the offences punishable under Sections 324, 506 read with Section 34 IPC and under Section 3(1)(r)(s) of SCs & STs (POA) Amended Act, 2015, against him.

Heard learned counsel for the petitioner/A3 and learned Additional Public Prosecutor representing the State. 3.

Learned Additional Public Prosecutor submits that the name of the petitioner i.e., M. Venkata Subba Reddy, was wrongly mentioned as Eswar Reddy, name of petitioner's father, as A3 in the FIR. 4.

Having regard to the facts and circumstances of the case and also in view of the nature of offences alleged against petitioner/accused, which are serious in nature and have to be investigated into by the investigating agency, this Court is not inclined to interfere with the proceedings initiated against the petitioner/A3.

However, in view of submissions of the learned counsel for petitioner that petitioner-A3 is apprehending his arrest in view of the pendency of the above crime, the police concerned are directed to complete the investigation into the crime without arresting the petitioner/A3 and file the final report, if any, in accordance with law.

ANIS,J Crl.P.14093 of 2016 However, in the event of necessity, the police concerned are directed to issue notice to petitioner/A3 requiring him to appear before the investigating agency for the purpose of investigation and on issuance of such notice, the petitioner/A3 shall appear before the investigating agency and give an undertaking as to his future appearance as and when required by the investigating agency for the purpose of investigation.

Accordingly, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions, if any, pending, shall stand closed.
