Petitioner claims that he is the owner of land to an extent of Ac.11-34 cents in Sy.No.495 of Chinarikatta Village, Konakanamitta Mandal, Prakasam District. According to the petitioner, it is a private patta land. Revenue records also reflect the name of the petitioner and pattedar pass book and title deeds were also issued. While so, the respondent-authorities are now trying to interfere and dispossess the petitioner, without following the due process, compelling him to invoke the jurisdiction of this Court.

When the matter is taken up, learned Assistant Government Pleader, produced letter in Rc.C/60/2017 dated 14.09.2017 addressed by the Tahsildar, to the learned Government Pleader. A reading of the letter would show that a complaint is filed by the villager alleging that the village tank is converted into private land and thereafter several sale transactions have taken place. It appears from the said instructions that the petitioner is in possession of the said property.

Prima-facie, view of the Tahsildar appears that there was tampering of record. However, the Collector seems to have directed the Tahsildar to follow the due process, before taking any action against the petitioner.

In view of the same, the Writ Petition is disposed of directing the respondents not to dispossess the petitioner without following the due process of law, as required. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
