THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.23072 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India challenging the proceedings of the Revenue Divisional Officer, Eluru, West Godavari District, in Rc.No.38/2016/C, dated 11-012016.

2. Heard both the counsel.

3. The petitioner was appointed as a Fair Price Shop dealer of shop No.31, Pentapadu village and Mandal, West Godavari District. While so, the 4th respondent served an order of temporary suspension, dated 11-01-2016 on the petitioner basing on the complaint made by the card holders of Pentapadu village and also on the preliminary enquiry conducted by the 5th respondent that the petitioner violated the control order of Clauses 22 (vi) and (vii) of Andhra Pradesh State Public Distribution System Control Order, 2008. After suspension of the dealership, the petitioner submitted a written explanation on 23-01-2016 to the 4th respondent. But, so far no orders have been passed. Hence, the writ petition.

4. The main grievance of the petitioner is that the written explanation made by the petitioner to the 4th respondent is kept pending for one reason or the other.

5. In view of the same, the Writ Petition is disposed of directing the 4th respondent herein to dispose of the written explanation submitted by the petitioner, dated 23-01-2016 after considering the material, if any, filed by the petitioner along with the order copy in accordance with law as expeditiously as possible preferably within a period of one month from the date of receipt of a copy of this order.
