Heard learned Counsel appearing for the petitioner and Sri R.Vinod reddy, the learned Standing Counsel appearing for the respondents No.1 to 4, and the learned Government Pleader for R.5.

According to the petitioner, he belongs to Scheduled Tribe community and is a small farmer and he owns an extent of Ac.1.21 gts., of agricultural land in Sy.No.664/ A situated at Sujathnagar village and mandal, BhadradriKothagudem District. It is further stated that he planted Eucalyptus trees in the said land by spending huge sums of money in the year 2014 and the said trees have now grown up. It is further stated that the staff of the 4th respondent have started laying the High Tension Lines through the petitioner's land without any intimation and no consent was obtained before resorting to that action. It is also stated that the respondents are threatening to remove the Eucalyptus trees.

On the other hand, it is submitted by the learned Standing Counsel appearing for R.1 to R.4 that the petitioner is entitled to claim the compensation if he suffers any damage because of laying of High Tension Line and has to make an application to the District Collector/ competent authority claiming the compensation.

Today, when the matter is taken up, a written representation, dated 18.04.2018, said to have been submitted

in the Office of the District Collector by the petitioner claiming compensation is placed on record and it is requested that the District Collector may be directed to take appropriate action on the said representation.

On the other hand, it is submitted by the learned Government Pleader that if any such representation is pending consideration before the District Collector, the same will be verified and appropriate action will be taken, in accordance with law.

Recording the said submission, this Court deems it appropriate to dispose of the Writ Petition, directing the 5th respondent/ District Collector to verify the representation, dated 18.04.2018, said to have been filed by the petitioner and take appropriate action, strictly in accordance with law, within a period of three months from the date of receipt of a copy of this Order.
