HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30199 of 2016 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents in conducting Survey of the petitioners' lands without following due procedure and in pressurizing the petitioners to surrender their lands under G.O.Ms.No.123, dated 30.07.2015, as illegal and arbitrary and for a consequential direction to the respondents to procure the petitioners' lands by adopting due procedure of law i.e., by invoking the provisions of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Heard learned counsel for the petitioners.

Learned Special Government Pleader appearing on behalf of the learned Advocate General made a statement that lands will be procured from the owners as per G.O.Ms.No.123, dated 30.07.2015 and if petitioners are not willing to part with their lands under the said G.O., the respondent authorities will follow the provisions of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and that action will be initiated only after following due procedure.

Recording the aforesaid statement made by the learned Special Government Pleader, the writ petition is disposed of directing the respondents not to evict the petitioners in respect of lands owned and possessed by them, without following due process of law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
