HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.36906 of 2016 ORDER:

The present Writ Petition is filed by the petitioner aggrieved over the highhanded action of Sub-Inspector of Police and Inspector of Police - Respondent Nos.1 and 2 respectively on the basis of the complaint lodged by the Respondent No.7.

After filing of this Writ Petition, the learned Assistant Government Pleader was directed to get instructions from the concerned officials. The learned Assistant Government Pleader, on instructions, informed as follows : It is true that Respondent No.7 has lodged a complaint against the petitioner herein. On the basis of the said complaint, once the petitioner was called over phone by the Respondent No.1 herein, since the 7th respondent's complaint reveals that the petitioner herein with the help of Nayeem got registered his father's land in his name. On enquiry by the Respondent No.1 over phone, the petitioner denied the allegations and thereafter, the petitioner was not called by the Sub-Inspector of Police - Respondent No.1 herein.

Apart from that, on the basis of the complaint lodged by the petitioner herein against the Respondent Nos.1 and 2, the Commissioner of Police directed the Assistant Commissioner of Police, Vanasthalipuram Division, to conduct enquiry. The Assistant Commissioner of Police after conducting enquiry informed that Respondent Nos.

over phone, not interfered with any of the affairs of petitioner herein. Hence, he closed the said complaint forwarded to him. Recording the said submissions made by the Assistant Government Pleader, the Writ Petition is disposed of with the following directions : The Respondent Nos.1 and 2 are directed not to interfere with any personal affairs of the petitioner, except on the basis of any case registered against the petitioner for any congnizable offence. No order as to costs. Consequently, Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
