THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1811 OF 2016 ORDER:
This Criminal Revision Case, under Sections 397 and 401 of Code of Criminal Procedure, 1973, is filed by the petitioner challenging the order, dated 21.04.2016, in Crl.M.P.No.76 of 2014 in F.C.O.P (M.C) No.97 of 2014 passed by the Judge, Family Court-cumXII Additional District Judge, Guntur, whereby the learned Judge directed the petitioner to pay an amount of Rs.1,000/- each per month to respondent Nos.1 to 3 herein as interim maintenance, till disposal of the M.C.
2. Respondent No.1 is wife and respondent Nos.2 and 3 are son and daughter of the petitioner. They filed M.C.No.97 of 2014 before the Court below seeking maintenance. They also filed Crl.M.P.No.76 of 2014 before the Court below seeking interim maintenance at Rs.3,000/- per month to respondent No.1 and Rs.2,000/- each per month to respondents 2 and 3, pending disposal of the maintenance case. The Court below partly allowed the said application granting interim maintenance at the rate of Rs.1,000/- each per month to Respondent Nos. 1 to 3. Aggrieved by the same, the present revision is filed by the petitioner.
3. Heard and perused the material available on record.
4. Having regard to the facts and circumstances of the case, without expressing any opinion on the merits of the case, this Criminal Revision Case is disposed of modifying the impugned order as follows:
5. The petitioner is directed to pay 50% of the maintenance as awarded by the Court below and continue to pay the same till disposal of M.C. He is also directed to pay the said maintenance amount on or
before 10th of every succeeding month and the arrears, if any, within three (03) months from the date of receipt of a copy of this order. The trial Court is directed to dispose of the M.C., as expeditiously as possible, preferably within a period of six (6) months uninfluenced by any observation made in this order.
6. Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
